These service terms and the privacy policy are agreements (the “agreements”) between you and HaysWatson®. By using the site, you accept and agree to be legally bound by the agreements, whether or not you are a registered user. If you do not understand or do not wish to be bound by the terms of the agreements, you should not use the site.

HaysWatson® reserves the right to modify these service terms at any time without advance notice. 

Any changes to service terms will be effective immediately upon posting on this page, with an updated effective data. By accessing the site after any changes have been made, you signify your agreement on a prospective basis to the modified service terms and all of the changes. When you register for services/instructions, you agree to pay the applicable services/instructions fee and any associated taxes. You consent to the receipt of an invoice or a statement of services/instructions fee, which shall be sent to you in an electronic format, to the email address that you provided upon registration. The price of services/instructions will be reflected in United States Dollars unless otherwise stated. If you select a part payment plan, you agree & authorize us to charge your card on the payment due date(s) for the amount(s) due. If you fail to make payment for a Services/instructions by the due date for payment (as agreed during registration and recorded in your invoice/statement of services/instructions fee), then we may suspend your participation in the Services/instructions. In such cases, you will not be permitted to access the services/instructions. At our discretion, we may permit you to resume access to the services/instructions, provided the outstanding payment has been paid by you before the services/instructions end date. You hereby acknowledge and consent to us contacting you in relation to payments due by you, by way of email, text message, telephone calls, or other means as determined by us. If you do not pay your fees in accordance with the agreed payment terms, you will not receive your final result for your Services/instructions, and this may impact your services/instructions completion. You will not be issued a certificate until all fees have been paid in full and you have completed the required services/instructions work.

The site and any information, content or services made available on or through the site are provided “as is” and “as available” without warranty of any kind (express, implied or otherwise), including, without limitation, any implied warranties of merchantability, fitness for a particular purpose and non-infringement, except insofar as any such implied warranties may not be disclaimed under applicable law. To the fullest extent permitted by applicable law, you agree that neither HaysWatson® nor any of the HaysWatson® ® partner will be liable to you for any loss or damages, either actual or consequential, arising out of or relating to these terms of service, or your (or any third party’s) use of or inability to use the site, or your placement of content on the site, or your reliance upon information obtained from or through the site, whether your claim is based in contract, tort, statutory or other law.

In particular, to the fullest extent permitted by applicable law, neither HaysWatson® nor any of the HaysWatson® partner will have any liability for any consequential, indirect, punitive, special, exemplary or incidental damages, whether foreseeable or unforeseeable and whether or not HaysWatson® or any of the HaysWatson® partner has been negligent or otherwise at fault (including, but not limited to, claims for defamation, errors, loss of profits, loss of data or interruption in availability of data).

You agree to defend, hold harmless and indemnify HaysWatson® and the HaysWatson® partner, and their respective subsidiaries, affiliates, officers, faculty, students, fellows, governing board members, agents and employees from and against any third-party claims, actions or demands arising out of, resulting from or in any way related to your use of the site, including any liability or expense arising from any and all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature. In such a case, HaysWatson® or one of the HaysWatson® partner will provide you with written notice of such claim, suit or action.

Termination rights; discontinuation of services/instructions and content. You agree that HaysWatson®, in its sole discretion, may terminate your use of the site or your participation in it, for any reason or no reason, upon notice to you. It is HaysWatson® policy to terminate in appropriate circumstances the accounts of users of the site who are repeat copyright infringers. HaysWatson® and the HaysWatson® partner reserve the right at any time in their sole discretion to cancel, delay, reschedule or alter the format of any services/instructions offered through HaysWatson®, or to cease providing any part or all of the site content or related services, and you agree that neither HaysWatson® nor any of the HaysWatson® partner will have any liability to you for such an action. If you no longer desire to participate in the site, you may terminate your participation at any time. The rights granted to you hereunder will terminate upon any termination of your right to use the site, but the other provisions of these service terms will survive any such termination. Entire agreement. These service terms and the privacy policy together constitute the entire agreement between you and HaysWatson® with respect to your use of the site, superseding any prior agreements between you and HaysWatson® regarding your use of the site. This user agreement will be governed by the laws of Canada applicable to contracts made and performed there without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the courts sitting in Canada and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

Privacy Terms

1. This website is owned and operated by the Hays Watson Inc., hereinafter referred to as “HaysWatson®”. This Privacy Policy only applies to information that we collect through the Hayswatson Website (the “Site,” which consists of all content and pages located within the hayswatson.com web domain) and does not apply to information that we may collect from you in other ways (for example, this policy does not apply to information that you may provide to us over the phone, by fax, or through conventional mail).

2. We may log the IP address, operating system, and browser software used by each user of the Site, and we may be able to determine from an IP address a user’s Internet Service Provider and the geographic location of his or her point of connectivity. Various web analytics tools are used to collect this information. Some of the information is collected through cookies. If you reject our cookies, many functions and conveniences of this Site may not work properly. Although user sessions are tracked, the users remain anonymous.

3. As a responsible organization, HaysWatson® is committed to maintaining a high standard of confidentiality with respect to the personal data of our students, alumni, employees, and faculty in accordance with the requirements.

4. To safeguard your personal data, all electronic storage and transmission of personal data are secured with appropriate security technologies.

a.  “Personal Data” is defined as personal information, whether true or not and whether in electronic or another form, about an individual who can be identified from that data; or from that data and other information to which we have access to or are likely to have access to. Examples of personal data are your name, address, Emirates ID/ Social Insurance Number / Social Security Number/ Adhar Card Number/ NRIC/FIN/Passport number, photograph or video image, telephone numbers and email addresses.

5. HaysWatson® and its partners (collectively “HaysWatson®”, “we” or “us”) collect, use and disclose your personal data for the following purposes in connection with the products or services which you have applied for, to the extent applicable:

a. General administration of your application and/or registration and/or inquiry, including those personal data collected by our recruitment agents, for any programme offered by us or our partners

b. For the purpose for which you specifically provided the information, for example, to respond to a specific inquiry or provide you with access to the specific course content and/or services you select.

c. To help us improve our offerings, both individually (e.g., by course staff when working with a student) and in aggregate, and to individualize the experience and to evaluate the access and use of the Site

d. For purposes of scientific research to determine your career path and product/service offerings.

e. To track both individual and aggregate attendance, progress and completion of a course, and to analyze statistics on student performance and how students learn.

f. To monitor and detect violations as well as other misuses and potential misuses of the Site.

g. To send you updates about courses offered by HaysWatson® or other events, to send you communications about products or services of HaysWatson®, HaysWatson® affiliates, or selected business partners that may be of interest to you, or to send you to email messages about Site maintenance or updates.

h. To authenticate your identity when needed

i. To process refunds, as applicable.

j. Conducting checks with the DO NOT CALL Registry;

k. Internal policies and procedures and any applicable laws, rules, regulations, codes of practice or guidelines, orders or requests issued by any court, legal or regulatory bodies (including but not limited to disclosures to regulatory bodies, conducting audit checks, surveillance, and investigation);

l. For purposes described elsewhere in this Privacy Policy (including, e.g., Sharing with Third Parties).

m. As otherwise described to you at the point of collection or pursuant to your consent.

6. By providing the Personal Data, including those related to a third party (e.g: information of your parents) to us through the various channels (e.g: written form, webpage), you represent and warrant that consent, including that of the third party, has been obtained for collection, use and disclosure of the Personal Data for the respective purposes.

7. HaysWatson® ensures that your Personal Data held by us shall be kept confidential. When transferring personal data to our third party service providers, agents and/or our affiliates or related corporations globally in order to carry out one or more of the purposes listed above, we will require them to ensure that your Personal Data disclosed to them is kept confidential and secure. 

8. HaysWatson® site may contain links to websites published by third parties, including other content providers as well as certain service providers, such as those who process payments on behalf of HaysWatson®. These other websites are not under our control, and you acknowledge and agree that we are not responsible for the collection and use of your information by such websites, unless we have otherwise indicated in this Privacy Policy. We encourage you to be aware when you are being redirected to a third party website and review the privacy policies of each website you visit and use.

9. HaysWatson® may employ other companies and individuals to perform functions on our behalf. They will need access to your personal information needed to perform their functions for HaysWatson®, but may not use it for other purposes. We will share information we collect with third parties as follows:

a. With service providers or contractors that perform certain functions on our Site, including managing our learning management system, hosting our videos and courseware, processing information that you provide to us on the Site, processing purchases via third party providers, and other transactions through the Site, operating the Site or portions of it, providing or administering courses, or in connection with other aspects of HaysWatson® services.

b. With other visitors to the Site, course platform or our mobile learning app, to the extent that you submit comments, coursework, or other information or content (collectively, “Postings”) to a portion of the Site, course platform or mobile learning app designed for public communications; and with other members of an HaysWatson® class of which you are a member, to the extent you submit Postings to a portion of the Site, course platform or mobile learning app designed for viewing by those class members. We may provide your Postings to students who later enroll in the same classes as you, within the context of the forums, the courseware, or otherwise. If we do re-post your Postings originally made to non-public portions of the Site, course platform or mobile learning application or learning management system we will post them without your real name and e-mail (except with your express permission), but we may use your username without your consent.

c. For purposes of scientific research, particularly, for example, in the areas of data analysis cognitive science and education. However, we will only share Personal Information about you for this purpose to the extent doing so complies with applicable law and is limited to the Personal Information required to fulfill the purposes stated at the time of collection.

d. To provide opportunities for you to communicate with other users who may have similar interests or educational goals. For instance, we may recommend specific study groups or connect potential student and coaches. In such cases, we may use all information collected about you to determine who might be interested in communicating with you.

e. To respond to subpoenas, court orders, or other legal process; to investigate, or prevent, or take action regarding illegal activities, suspected fraud, or security or technical issues, or to enforce our terms and conditions, or this Privacy Policy; as otherwise may be required by applicable law; or to protect our rights, property, or safety or those of others.

i. With affiliates of HAYSWATSON®or with successors in the event of a merger, acquisition or reorganization, for their use consistent with this Privacy Policy.

ii. As otherwise described to you at the point of collection or pursuant to your consent.

10. In addition, HaysWatson® may share aggregated information that does not personally identify you with the public and with third parties, including but not limited to researchers and business partners. Please keep in mind that whenever you voluntarily disclose personal data online – for example on message boards, through e-mails, or in chat areas – that information can be collected and used by others. By posting personal data online that is publicly accessible, you may receive unsolicited messages from other parties in return.

11. Please note that we review and may make changes to this Privacy Policy from time to time. When changes are made, the Privacy Policy link will include a notation “Revised (date).” indicating that you should review the new terms, which will be effective immediately upon posting on this page, with an updated effective date. The notation will be included in the Privacy Policy link for at least seven (7) days after the update has been made. By accessing the Site after any changes have been made, you signify your agreement on a prospective basis to the modified Privacy Policy and any changes contained therein.
